Scope of Trademarks That Can Be Registered
Following amendments under the WTO-related provisions, a trademark may be any sign that is visually perceptible and can be represented graphically. In particular, it may be composed of a combination of text, personal names/names, letters, numbers, graphical elements, and colours, including any combination of the foregoing elements.
Three-Dimensional Trademarks
A trademark may include a three-dimensional form, but it must be recordable and publishable—for example, in the form of drawings or a textual description.
Increasing the Chances of Registration Success
To increase the chances of successful registration, it is recommended that the customer provides a trademark design created by themselves wherever possible, and that the wording-level meaning is not particularly obvious. At the same time, ensure the trademark is distinctive and novel.
